Burnout Mobile Tires LLC – Terms & Conditions

These Terms and Conditions ("Terms") govern all mobile tire and related services provided by Burnout Mobile Tires, LLC ("Burnout Mobile Tires", "we", "us", or "our"). By scheduling, authorizing, or utilizing any of our services, you (the "customer") acknowledge that you have read, understood, and agree to be bound by these Terms.

Please read these Terms carefully before your appointment. If you do not agree to these Terms, you should not schedule or use our services.

Effective Date & Applicable Law

These Terms are effective as of the date you schedule or receive service and apply to all services performed by Burnout Mobile Tires, LLC within the state of North Carolina. To the fullest extent permitted, these Terms are governed by the laws of the State of North Carolina without regard to its conflict of laws principles.

1. Service Agreement

1.1 Description of Services

Burnout Mobile Tires, LLC provides professional mobile tire and related automotive services at a customer-designated location, when reasonably accessible and safe. Services may include, but are not limited to:

  • Tire installation
  • Tire replacement
  • Tire repair
  • Tire rotation
  • Tire balancing
  • TPMS sensor service
  • Mobile oil change services
  • Roadside tire assistance

Services are performed on the vehicle identified by the customer and only at locations we determine to be reasonably accessible and safe for both our technicians and equipment.

1.2 Scope of Work & Additional Services

Our services will be performed on the specific vehicle identified by you at the agreed-upon location. Any additional services requested after arrival, or issues discovered during service, may result in additional charges. These issues may include, but are not limited to:

  • Seized or rusted lug nuts
  • Stripped wheel studs
  • Damaged or bent wheels
  • Incorrect tire sizes provided
  • Previously improper repairs or modifications

You will be notified of any such conditions and associated costs before additional work is performed. If you decline additional recommended services, you accept any risk associated with proceeding without them.

1.3 Customer Responsibility for Vehicle Information

You are solely responsible for providing accurate and complete vehicle and tire information, including but not limited to:

  • Correct tire size and load/speed rating
  • Vehicle make, model, and year
  • Wheel size and type
  • Modifications or aftermarket components (lift kits, custom wheels, spacers, etc.)

Burnout Mobile Tires, LLC is not responsible for delays, incorrect parts, service complications, or additional costs caused by inaccurate, incomplete, or omitted information provided by the customer.

2. Pricing and Payment

2.1 Quotes and Estimates

All quotes provided by Burnout Mobile Tires, LLC are good-faith estimates based on the information supplied by you at the time of scheduling or inquiry. Final pricing may differ from the initial quote if:

  • The actual vehicle condition differs from what was described
  • Additional labor is required due to unforeseen conditions
  • Additional services or products are requested on-site

Your approval will be obtained before any additional work is performed that would result in additional charges.

2.2 Payment Terms

Payment in full is due immediately upon completion of services, unless otherwise agreed in writing by Burnout Mobile Tires, LLC prior to the start of work. We currently accept the following payment methods:

  • Cash
  • Credit or debit cards
  • Mobile payments (Apple Pay, Cash App, Zelle, and similar services)

2.3 Late Payment & Collections

Any unpaid balance after services are rendered may be subject to late fees, interest, and/or collection efforts as permitted by applicable law. Burnout Mobile Tires, LLC reserves the right to:

  • Assess reasonable late fees on overdue balances
  • Engage third-party collection services, where necessary
  • Refuse or suspend future services until all outstanding balances are paid in full

2.4 Deposits for Special Orders and High-Value Services

A non-refundable deposit, typically equal to fifty percent (50%) of the total estimated cost, may be required for:

  • Special order tires or products
  • Large or bulk tire orders
  • High-value or custom services

Deposits are applied to the final invoice but are non-refundable in the event of cancellation, rescheduling outside of our policy, or refusal of service upon arrival where no fault lies with Burnout Mobile Tires, LLC.

3. Customer Responsibilities and Vehicle Condition

3.1 Service Location Requirements

You must provide a safe, legal, and reasonably accessible location for our mobile service vehicle and technicians. This includes, but is not limited to:

  • Stable, level ground suitable for lifting the vehicle
  • Adequate working space around the vehicle and service truck
  • A safe environment free of hazards, obstructions, or illegal parking
  • Compliance with any local rules (e.g., HOA, workplace, or property restrictions)

Burnout Mobile Tires, LLC reserves the right to decline, postpone, or stop service if we determine, in our sole discretion, that the environment is unsafe or unsuitable. In such cases, a service or trip fee may still apply.

3.2 Personal Property

You are responsible for removing any valuables or personal items from the vehicle before service begins. Burnout Mobile Tires, LLC is not responsible for lost, stolen, or damaged personal property left in the vehicle or surrounding area during service.

3.3 Pre-Existing Damage

Burnout Mobile Tires, LLC is not responsible for damage or issues arising from pre-existing conditions, hidden defects, or prior improper work on your vehicle. This includes, but is not limited to:

  • Rusted, seized, or over-torqued lug nuts
  • Stripped or damaged wheel studs
  • Bent, cracked, or otherwise damaged rims
  • Faulty or corroded TPMS sensors
  • Previous improper repairs, installations, or modifications
  • Underlying suspension, steering, or brake system issues

If such conditions are discovered during service, we will notify you and may recommend additional repairs or services. Certain work may be refused or halted if proceeding could reasonably cause further damage or safety concerns.

3.4 Post-Service Notification

You agree to inspect your vehicle as soon as reasonably possible after service. Any concerns, questions, or issues related to the services performed must be reported to Burnout Mobile Tires, LLC within forty-eight (48) hours of service completion. Failure to notify us within this timeframe may limit or void certain service-related claims to the fullest extent permitted by law.

4. Warranty and Disclaimers

4.1 Workmanship Warranty

Burnout Mobile Tires, LLC provides a limited 30-day workmanship warranty on labor performed. This warranty covers errors in installation or service performed solely by our technicians, such as improper mounting or balancing of tires, where proven to be our responsibility.

4.2 Tire Manufacturer Warranty

New tires sold and installed by Burnout Mobile Tires, LLC are covered exclusively by the manufacturer’s warranty, if any, and not by Burnout Mobile Tires, LLC. We do not alter, extend, or assume any manufacturer warranty obligations. When applicable, we may assist you in initiating or processing a warranty claim with the manufacturer, but final decisions on coverage rest with the manufacturer.

4.3 Warranty Exclusions

The workmanship warranty does not cover damage or issues caused by factors outside of our control, including but not limited to:

  • Road hazards (nails, screws, potholes, debris, curbs, etc.)
  • Improper tire pressure, under-inflation, or over-inflation
  • Vehicle alignment issues or suspension problems
  • Off-road use, racing, competition, or other extreme use
  • Accidents, collisions, or vandalism
  • Negligence, misuse, abuse, or failure to maintain the vehicle
  • Repairs, alterations, or installations performed by third parties after our service

4.4 Used Tire Disclaimer

Used tires are sold strictly "AS-IS" with no warranty of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. By purchasing and/or having used tires installed by Burnout Mobile Tires, LLC, you acknowledge and accept the inherent risks associated with used tires, including unknown prior usage, age, or potential hidden defects.

5. Limitation of Liability

To the fullest extent permitted under the laws of North Carolina, Burnout Mobile Tires, LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind arising out of or related to the services provided. This includes, without limitation:

  • Loss of vehicle use or downtime
  • Loss of income, wages, or business opportunities
  • Property damage not directly and proximately caused by our proven negligence

In all cases, the total liability of Burnout Mobile Tires, LLC for any claim, damage, or loss arising out of or related to the services provided shall not exceed the total amount actually paid by you for the specific service giving rise to the claim. Some jurisdictions do not allow limitations on certain damages, so some of the above limitations may not apply to you; however, in such cases, our liability shall be limited to the maximum extent permitted by applicable law.

6. Consent to Service

By allowing Burnout Mobile Tires, LLC to begin work on your vehicle, you acknowledge and agree to be bound by these Terms and Conditions. Consent to service may be provided in one or more of the following ways:

  • Verbally, including by phone or in-person confirmation
  • By scheduling service through phone, text, online, or other booking methods
  • By signing an estimate, work order, or invoice (physically or electronically)
  • By granting our technicians access to the vehicle and allowing work to begin

If you are not the legal owner of the vehicle, you represent that you have the authority to consent to services on behalf of the owner or responsible party and agree to these Terms on their behalf.

7. Force Majeure

Burnout Mobile Tires, LLC shall not be responsible for any delay, rescheduling, or inability to perform services due to events or circumstances beyond our reasonable control, including but not limited to:

  • Severe or hazardous weather conditions
  • Traffic accidents, road closures, or unsafe travel conditions
  • Equipment failure or breakdown not caused by our negligence
  • Natural disasters or acts of God
  • Government regulations, restrictions, or emergencies

In such situations, we will make reasonable efforts to communicate with you and reschedule services as soon as practical but will not be liable for any resulting delay-related losses or inconveniences.

8. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable North Carolina law, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any one provision shall not affect the validity or enforceability of the remaining Terms.

9. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Burnout Mobile Tires, LLC with respect to the services provided and supersede any and all prior or contemporaneous understandings, agreements, discussions, or representations, whether written or oral, relating to the subject matter hereof.

No amendment or modification of these Terms shall be binding unless made in writing and signed by an authorized representative of Burnout Mobile Tires, LLC. Your continued use of our services after any updates to these Terms will constitute your acceptance of the revised Terms.
